These Terms and Conditions ("Terms") govern access to and use of the QuickParcel platform, available at qparcels.com and its associated web and mobile applications (the "Platform"), operated by Abacus Consultancy Services (I) Pvt Ltd ("ACS", "we", "us", or "our"). By accessing the Platform, creating a Buyer account, or using any QuickParcel service, you ("User", "you") agree to be bound by these Terms and our Privacy Policy (together, the "Agreement"). If you do not agree, do not access or use the Platform.
1. About QuickParcel
QuickParcel is a booking platform that lets companies ("Buyers") search station-to-station routes, compare available trains, prepay securely, and track rail parcel freight across India without contacting a lease holder directly. QuickParcel is a booking and tracking intermediary; the physical carriage of parcels by rail is performed by the relevant Indian Railway parcel lease holder handling a given route, under their own leave/lease licence and applicable Indian Railways rules, which QuickParcel does not control.
2. Definitions
- Buyer — the company account that registers on QuickParcel to search, book, and prepay for parcel freight.
- User — an individual added to a Buyer account under Company Users, with an Admin or User role.
- Lease Holder — the Indian Railway parcel space lease/licence holder who fulfils a booking made through QuickParcel.
3. Eligibility & Account Registration
You must be at least 18 years old and capable of entering into a binding contract under Indian law to register a Buyer account. You are responsible for the accuracy of the information you provide and for maintaining the confidentiality of your login credentials. You must notify us immediately of any unauthorised use of your account. A Buyer's Admin User is responsible for all activity carried out by Users added under that Buyer account.
4. Bookings & Prepayment
All bookings made through QuickParcel require full prepayment at the time of booking — QuickParcel does not offer "To Pay" or running-account booking. Bookings, weight entries, and booking slips are based on information supplied by the Buyer at the time of booking. QuickParcel is not responsible for penalties, delays, or disputes arising from inaccurate declared weight, incorrect receiver details, or prohibited/undeclared goods booked through the Platform. Actual weight verification, compartment capacity, and compliance with Indian Railways parcel regulations remain the responsibility of the Lease Holder and station staff who accept and carry the parcel.
5. Payments, Charges & Refunds
Charges shown at booking are set by the Lease Holder assigned to the selected route and collected upfront by QuickParcel on their behalf; QuickParcel is a technology and booking provider and is not itself the carrier for any parcel booked through the Platform. Any payment gateway used for prepayment on the Platform operates in accordance with applicable Reserve Bank of India (RBI) guidelines, and payment instruments are subject to their issuer's terms. Cancellation and refund eligibility for a prepaid booking depends on the Lease Holder's policy for that route and the stage the parcel has reached in its journey.
6. Roles & Responsibilities
Each account type carries specific responsibilities:
- Buyers are responsible for the accuracy of booking, sender, and receiver information entered by their Users, and for their internal Users' conduct on the Platform.
- Lease Holders are responsible for accepting, weighing, loading, carrying, and delivering parcels booked against their routes, in accordance with their own leave/lease licence with Indian Railways.
7. Acceptable Use
You agree not to: (a) use the Platform for any unlawful purpose or to book prohibited/hazardous goods; (b) attempt to gain unauthorised access to any account, data, or system; (c) reverse-engineer, scrape, or interfere with the Platform's normal operation; or (d) upload content that is fraudulent, defamatory, or infringes third-party rights. We may suspend or terminate accounts that violate this section.
8. Intellectual Property
The Platform, including its software, design, trademarks, and content, is owned by or licensed to ACS and is protected by applicable intellectual property laws. Nothing in these Terms transfers ownership of the Platform to you. You retain ownership of data you upload (e.g. booking records), and you grant us a licence to process it solely to provide the Platform's services to you and to the Lease Holder fulfilling your booking.
9. Limitation of Liability
To the maximum extent permitted by law, QuickParcel and ACS shall not be liable for any indirect, incidental, or consequential damages, including loss of revenue, data, or goodwill, arising from use of the Platform. Our aggregate liability for any claim relating to the Platform is limited to the booking fees paid by the affected Buyer in the three (3) months preceding the event giving rise to the claim. Nothing in this section limits liability that cannot be excluded under applicable law.
10. Termination
We may suspend or terminate access to the Platform, immediately and without notice, if an account is used in violation of these Terms, applicable law, or if continued provision of the service is disrupted by a third-party facility provider (e.g. payment gateway, hosting, or SMS/WhatsApp provider) for reasons outside our control. A Buyer may close their account at any time; termination does not affect fees already accrued or bookings already in progress.
11. Force Majeure
We shall not be held liable for any delay or failure to perform our obligations under this Agreement resulting from events beyond our reasonable control, including but not limited to natural disasters, strikes, disruption to Indian Railways operations, internet or telecommunications outages, or governmental action.
12. Changes to These Terms
We may update these Terms from time to time to reflect changes to the Platform or applicable law. Material changes will be notified via the Platform or by email. Continued use of the Platform after changes take effect constitutes acceptance of the revised Terms.
13. Governing Law & Dispute Resolution
This Agreement is governed by the laws of India. Any dispute arising out of or in connection with this Agreement shall first be referred to arbitration under the Arbitration and Conciliation Act, 1996, with the seat of arbitration in Mumbai, Maharashtra. Subject to the foregoing, the courts at Navi Mumbai, Maharashtra shall have exclusive jurisdiction.
